These general terms and conditions apply to the use of the website, platform, app, and services of The One To Watch B.V.

By using our services or placing an order/subscribing, you agree to these general terms and conditions.

2. Services

The One To Watch offers data-driven and AI-powered football analysis for players, teams, and clubs.

Depending on the chosen package, our services may include, among other things, the uploading and analysis of match footage, player and team statistics, automated video clips, personalized reports, player profiles, team analyses, the Team Management System (TMS), the Match Management System (WMS), a dashboard, and access to the app. (The One To Watch)

The scope of the services depends on the chosen package. The One To Watch may improve, expand, or modify features in the future.

3. AI Analysis

The One To Watch analyses are performed—either wholly or in part—using AI technology. The quality of an analysis may depend, among other factors, on the quality and completeness of the match footage provided.

AI analyses, statistics, scores, and clips are intended as tools for players, coaches, parents, teams, and clubs. No guarantees regarding athletic performance, team selection, or other sporting outcomes can be derived from the results.

4. Match Footage and Data

The user is responsible for the lawful submission of match footage, player lineups, and other data.

When footage or personal data concerning other individuals—including minors—is submitted, the user is responsible for obtaining any necessary consent and complying with applicable privacy laws.

The One To Watch processes data in accordance with the GDPR. Further information on this can be found in our Privacy Statement.

5. Account and Usage

To use certain services, the user is granted access to the dashboard and/or the app.

Login credentials are personal and may not be shared with third parties without permission. The user is responsible for keeping their login credentials secure.

Misusing, disrupting, or copying the platform, or using it for illegal purposes, is prohibited.

6. One-off Reports and Subscriptions

The One To Watch offers both one-off analyses and various subscription plans for players, teams, and clubs.

The price, duration, and content of a subscription are clearly stated at the time of purchase.

One-off services are paid for using the available payment methods. Subscription fees are collected periodically according to the chosen payment method. Currently, payment options for initial purchases and one-off services include iDEAL and credit card, among others. Subscriptions are paid via direct debit. (The One To Watch)

7. Cancellation and right of withdrawal

Statutory rules regarding cancellation and the right of withdrawal apply to consumers.

For digital services, the statutory right of withdrawal may lapse under certain conditions if the consumer gives express consent for the provision of the service to begin before the end of the cooling-off period.

For business customers, the terms set out in the relevant agreement apply.

8. Intellectual property

All intellectual property rights regarding the platform, software, AI technology, analyses, reports, texts, designs, logos, and other materials belonging to The One To Watch remain the property of The One To Watch or its licensors.

Copying, distributing, selling, or commercially using these materials without prior written consent is prohibited.

The user retains rights to their own submitted material, insofar as those rights belong to the user.

9. Availability

The One To Watch strives to keep the platform and app available in a proper and reliable manner. However, we cannot guarantee that our services will always be available without interruption.

Maintenance, technical issues, internet outages, or disruptions at third-party suppliers may temporarily affect availability.

Based on current information, an analysis is processed within a maximum of 24 hours after the match video has been submitted. (The One To Watch)

10. Liability

The One To Watch is not responsible for decisions made by users based on analyses, statistics, scores, clips, or other information made available through our services.

To the extent permitted by law, The One To Watch is not liable for indirect damages or damages arising from incorrect, incomplete, or unsuitable information provided by the user.

This provision does not limit any statutory liability that cannot be excluded.

11. Amendments

The One To Watch may amend these general terms and conditions and the services offered when necessary. Users will be informed of significant changes.

13. Applicable law

These general terms and conditions and agreements with The One To Watch are governed by Dutch law.

For consumers, statutory rights and protective regulations remain fully applicable.
